Scope
Our terms and conditions apply to all purchases at and deliveries from Weinfurore e.K., Owner Gerhard Biber, Neumarkter Str. 55, 81673 Munich, Germany (hereinafter "Weinfurore") in the present version.Customers in regards to these terms and conditions are both consumers and businesses. Consumers are natural persons who conclude contracts for a purpose that can not be attributed to their commercial or professional activity. Businesses are natural persons, legal entities or partnerships who exercise a commercial or professional activity when dealing with Weinfurore.
Pricing, Tax and Customs
All prices are stated in Euro including German value-added tax (VAT) per 0,75 l bottle of wine if not stated otherwise. Listing of products in our online shop does not constitute a binding offer to sell, but an invitation to place an offer to buy, subject to prior sale either online or in our store. Available quantities and prices are confirmed only by receipt of the goods and/or invoice.For deliveries outside of the European Union (billing and shipping address outside of the EU required), the German VAT will be credited during checkout. Depending on the shipping method chosen by the customer, applicable taxes, customs duties and fees will be either (A) charged during checkout or (B) have to be paid by the customer upon receipt of the goods. With option (A), customer pays a final price without any further steps necessary for customs clearance. With option (B), customer is responsible to pay taxes, customs duties and fees as charged by the local authorities.
Conclusion of Purchase Contract
Clicking the submit order now button constitutes your offer to purchase goods as ordered. You will immediately receive a confirmation of receipt by e-mail after submitting the order which does not represent a formal order confirmation and thus an acceptance of your offer to purchase. The purchase contract is only concluded by delivery of the goods within the delivery time stated with each individual product or by our explicit order confirmation sent by e-mail within 5 days of your order. The purchase contract will be concluded with Weinfurore e.K., Gerhard Biber, Neumarkter Str. 55, 81673 Munich, Germany in German or English language. With submitting your order you consent to receive invoices electronically by e-mail. Customer and order data will be electronically stored in our IT systems according to our privacy policy. The purchase contract text however will not be saved and is not available for download after conclusion of the purchase contract. A summary of your order can be printed before submitting it, you will also receive a summary by e-mail after submitting it and can review your order at any time in your customer account. The terms and conditions as well as all information regarding your right to cancel can be downloaded from our website at any time. For changes to your order, returns or complaints please contact us by phone or e-mail during our business hours.Shipping and Shipping Costs
Orders will be delivered by the forwarding company (UPS, DHL) stated during check-out, usually within three working days within Germany and within 7 working days in Europe. Longer delivery time due to availability is indicated in our online shop during the ordering process. In case delivery fails (e.g. due to a wrong address or unavailability of the recipient) and the goods are returned, the contract has not been concluded and any payments already made will be reimbursed immediately less any return transport costs.Packing and shipping cost is depending on order size and destination country, exact shipping costs are displayed in our online shop during check-out and listed in the shipping cost overview.
Payment
Payment for goods ordered is due net immediately and payable by advance payment, credit card, PayPal, cash on pick-up or for regular customers and resellers by direct debit or invoice/wire transfer with payment 7 days due net. When using direct debit via the SEPA system, we will charge your account 10 days after shipping your order. You will receive a separate pre-notification before debiting with reduced pre-notification period of 10 days.In case of payment delay or cancellation of a direct debit, buyer is responsible to bear all costs associated with collecting seller's receivables, especially bank fees and costs for collecting agencies and attorneys as well as default interest on arrears of 5% above the current base rate. Additionally, a fee of 5,- € will be charge per administrative act during payment collection.
